Terms of Service

1. Who you are contracting with
These Terms of Service are a legal agreement between you and Ozan Ismail, trading as Launchpad Websites. By signing up, subscribing to or using our services, you agree to be bound by these terms. If you are using the service on behalf of a business or organisation, you confirm that you have authority to bind that entity.
2. Acceptance of terms
By accessing or using Launchpad Websites, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the service. We may update these terms from time to time; continued use after changes means you accept the updated terms.
3. Our service
Launchpad Websites provides custom website design, hosting, SSL, SEO groundwork and ongoing content updates on a subscription basis. The specific scope depends on the plan you select. We aim to deliver high-quality work, but we do not guarantee uninterrupted or error-free performance at all times.
4. Subscriptions, billing and Paddle
Subscriptions are billed monthly or yearly depending on the plan you choose. Payments are processed by our online reseller, Paddle. By subscribing, you agree to Paddle's Buyer Terms, which govern payment, billing, tax, cancellation and refund mechanics. Please review them at paddle.com/legal/checkout-buyer-terms.
Merchant of Record disclosure: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
5. Acceptable use
You may not use our service for unlawful purposes, fraud, spam, harassment, intellectual property infringement, distribution of malware, security interference, scraping, reverse engineering, or any activity that harms our systems, users or reputation. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
6. Intellectual property
We retain ownership of our platform, tools, processes and pre-existing IP. Upon full payment and completion of your project, we grant you ownership of the custom design, copy and imagery created specifically for your website. You warrant that any content you provide does not infringe third-party rights. We may suspend or remove content that violates this warranty.
7. Service level and warranties
We provide the service on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee specific search rankings, revenue outcomes or uninterrupted uptime, although we make every reasonable effort to maintain reliable hosting.
8. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay amounts due, create a security or fraud risk, or repeatedly violate our policies. Upon cancellation or termination, your site will remain live until the end of the current paid period unless otherwise agreed. We may delete or archive project files after a reasonable retention period.
9. Limitation of liability
To the extent permitted by law, our aggregate liability is capped at the total fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special or punitive damages, including lost profits, data loss or reputational harm, except where liability cannot be excluded by law (such as fraud, death or personal injury).
10. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which Ozan Ismail operates, and any disputes will be resolved in the courts of that jurisdiction. We encourage you to contact us first so we can attempt to resolve any issue informally.
